Ripple's General Counsel Stuart Alderoty Calls SEC a Bully

Stuart Alderoty, Ripple's general counsel, said the U.S. Securities and Exchange Commission (SEC)'s unsubstantiated allegations were disguised as controls to bully the encryption market.

Instead of creating rules to provide regulatory clarity, the SEC is bullying the crypto market with unsubstantiated allegations. In my latest column, I outline Washington's urgent need for sensible encryption legislation.

Linking to his brand new opinion piece discussing the SEC's focus on enforcement rather than regulation, Aldrotti chided the SEC for not providing the clarity companies need by creating modest rules. Instead, legal experts claim, the SEC is more concerned that, without appropriate regulation, the actions of companies may be influenced by the law.

Alderoty also detailed the events of last week's House Financial Services subcommittee regulatory hearing. There is no policy to explore enforcement cases, but Subcommittee Chairman Representative Brad Sherman took the liberty of discussing the SEC vs. Ripple case.

Just last week, the Fox Business Network released a message that Congressman Sherman believed the SEC would have an easy case against Ripple. The congressman also added that he has been working with members of Congress. SEC Chairman Gary Gensler kept in touch. But when Ripple lawyers raised the legality of releasing the evidence, members of Congress shied away and blamed Fox for miscommunication.

This is why Congress needs to resolve this type of confusion and provide a comprehensive legislative framework for digital currencies. Defining the line between securities and commodities in the digital currency industry (the Data Commodity Exchange Act and the Responsible Financial Innovation Act) is a good start.

Brief recap: In 2020, the SEC sued RippleLabs for issuing and selling unlicensed security XRP tokens to the public. Since then, the SEC and Ripple have been embroiled in a legal battle, with new bumps emerging every few days.
